Person kidnapped, released near Foley

On 10/30/13 Investigators from the Sherburne County Sheriff’s Office Criminal Investigation Division (CID) arrested Henry Maybury, 51, Clear Lake, MN for 2nd degree assault.


According to Sheriff Joel Brott, the Sheriff’s Office received a complaint from the Benton County Sheriff’s Office that an individual who was being transported to the St. Cloud Hospital for the treatment of injuries, claimed to have been assaulted in Sherburne County.

The victim alleged to investigators they had been taken at gun point from a residence in Clear Lake Township to a second residence a short distance away.  Once at that residence, the victim alleges that Maybury used a steel pipe and broke the victim’s hand, as Maybury believed the victim was stealing in the area.

The victim alleges that they were then placed in a vehicle, at gun point, and transported to an area north of Foley, MN, where the victim was released.  The victim was able to obtain a ride to the Benton County Sheriff’s Office, where they reported what had occurred.

Investigators executed a search warrant at Maybury’s residence, where they located a steel pipe as described by the victim and a holster for a handgun similar to that described by the victim.

Maybury was arrested without incident and transported to the Sherburne County Jail.  A criminal complaint was filed in Sherburne County District Court charging Maybury with Kidnapping and 2nd degree assault.
