Man busted on drug charges in restaurant parking lot

A Foreston man wanted on felony warrants could soon have a drug conviction added to his criminal record.

Michael W. Gavin, 33, of Foreston, was parked in a vehicle at the Hardee’s restaurant in Milaca on Jan. 1 when a Sherburne County investigator called upon the Milaca Police and Mille Lacs County Sheriff departments for an assist on a felony


warrant arrest.

A female in the vehicle, who identified herself as Leah Marie O’Neal, did not come back on file. She was fingerprinted using a portable fingerprinting device and was identified as Ashley Jo Mortenson, 26, of Minneapolis, who had an active warrant in Hennepin County. Court records show that Mortenson admitted to lying about her identity because she was aware of the warrant.

Both Gavin and Mortenson were taken into custody.

A subsequent search of Gavin’s vehicle uncovered a scale with a white residue on it, a glass pipe for use with methamphetamine, a small amount of marijuana, a white pill believed to be codeine with acetaminophen, pipes used for smoking marijuana and a plastic bag with 12.8 grams of a white substance identified as methamphetamine, according to a criminal complaint filed in Mille Lacs County District Court.

Gavin admitted in a statement to investigators that the meth, scale, paraphernalia and pill belonged to him, the complaint states.

He was charged in court with second-degree possession of a controlled substance, a felony punishable by a maximum of 25 years in prison and a $500,000 fine for the possession of the meth. He was also charged with fifth-degree drug possession and possession of drug paraphernalia.
