Herzing on unpaid leave: Board says candidacy a conflict

The Mille Lacs County Board placed Assistant County Attorney Mark Herzing on unpaid administrative leave July 15 until he is no longer a candidate in the race for Mille Lacs County attorney.
The county board’s motion (made by Dave Oslin and seconded by Genny Reynolds) concurred with the recommendation by the county’s personnel board of appeals (PBA). The PBA agreed with Mille Lacs County Attorney Jan Jude’s allegation that Herzing’s candidacy for the county attorney’s office is a “conflict of interest” being that he is an employee of the office.
Herzing is one of two people opposing Jude in her bid for reelection.
The county board agreed that the conflict of interest would end if Herzing is defeated in the Aug. 12 primary election that will narrow the field to two candidates for the general election.
Jude had already placed Herzing on a paid administrative leave June 24.
The PBA concluded that Herzing’s campaign “creates an incongruity between his duty to the public good and his self interest in winning his election.”
Herzing said afterward he was disappointed in the decision.

    I am so disappointed in Mr Oslin! How dare you, as a county employee, with a Jan Jude sign in your yard, vote to put Mark Herzing on unpaid leave. I have heard for years that the county board and Ms. Traxler have no ethics and this proves it. Using the excuse of conflict – then why isn’t Jan also put on leave? I am shocked that Jan started the process by putting Mark on paid leave and that the board went one step further with the unpaid leave. Why should Mark be treated any different than Jan? I hope people start really looking at what is happening at the county, the unethical processes that Ms Traxler & other department heads are doing and start to ask questions, be involved in meetings (when allowed to be in open meetings)and vote, vote, vote!     The unpaid leave “until he (Mr Herzing) is no longer a candidate in the race for Mille Lacs County attorney” is ridiculous. Ms Jude came in 3rd in the primary and will not even be on the ballot.

    Now that the primary is over and it is down to a 2 person race will Herzing remain on unpaid leave because there still may be “conflict” because he defeated the incumbent, his supervisor?
